Welcome to Karen Lucas Photo Art, a division of Baobab Photo Pte Ltd.

Please read the following Terms and Conditions (T&Cs) that govern your use of this website. Your continued use of this website constitutes your agreement to be bound by the T&Cs. By purchasing from Baobab Photo Pte Ltd (hereafter also known as “Baobab Photo”), you are deemed to have agreed to the T&Cs, including but not limited to ordering, payment, exchange and shipping terms.

GENERAL

www.karenlucasphoto.com/art is an online photo art store operated by Baobab Photo. Baobab Photo can be reached at karen@karenlucasphoto.com. The content of the pages on its website may change from time to time without prior notice as deemed appropriate. Baobab Photo therefore encourages you to refer to its T&Cs on an on-going basis.

CONTENTS

The content, design, layout, images and illustrations on www.karenlucasphoto.com/art are the property of Baobab Photo. You may not reproduce, publish, modify, distribute or create derivative works found on its website. Unauthorized use of any material contained on its website may violate copyright laws and be subject to claims for damages.

TRANSACTIONS

Placing of an order by the buyer will be regarded as an offer to buy. Baobab Photo has the absolute discretion to choose to accept or not to accept the buyer’s offer to buy.

Upon receipt of orders, orders and payment details will be verified. A confirmation will be sent after verification.  Baobab Photo will not be liable if the transactions cannot be completed due to various reasons such as website issues, system glitches, payment gateway malfunction, etc.

DELIVERY & COLLECTION

All orders will be processed upon receipt of full payment.   

Orders may be collected from the Baobab Photo office at 201 Kew Crescent, Kew Green, Singapore, 466124.

Delivery Fee is $40.

Delivery within Singapore is free for orders over $500. 

Orders are deemed to have been fulfilled when Baobab Photo has dispatched the ordered item(s) for delivery or they have been collected.

Baobab Photo reserves the right to choose the mode of delivery. The ordered item(s) will be delivered to the shipping address provided by the buyer. Buyer must ensure the shipping address provided is complete and accurate.

Each product is made to order.  Estimated lead times are 10-14 days from date or order. Delays may occur at times and Baobab Photo will not be held responsible or liable for any delay.

NON-DELIVERY

If an item is returned due to non-delivery or unsuccessful delivery attempt, re-delivery of the item is possible, but the additional costs will have to be borne by the buyer. 

Cancellation of Orders

Baobab Photo will refund the amount paid if the order is cancelled due to the unavailability of goods or our inability to deliver the goods within the agreed time frame.

Baobab Photo will not entertain any cancellations once the order is confirmed and submitted by the customer.

PAYMENT

Prices stated on the website are in Singapore dollars. The Buyer shall comply with the payment procedure set out on the payment web page. Payment can be made via PayPal (Visa/Mastercard), Bank Transfer or Cheque.

Any confidential information supplied to Paypal is held by PayPal and not by Baobab Photo.  Hence, Baobab Photo cannot be liable for any claim for fraud or misuse of information (if any).

RETURNS OR EXCHANGE

All our goods sold are non-exchangeable and non-refundable.  Baobab Photo will make every effort to ensure the product sent is per customer order and in good condition. Refund or exchange is possible if the wrong product was sent. To request a refund or exchange, send an email to karen@karenlucasphoto.com within 3 days of receipt of the order. Buyer should provide the order number and indicate return or refund in the email subject.

Buyer should ensure the incorrect product received is properly stored, in good original condition and intact in its original packaging while refund or exchange is being arranged. If the product is found damaged, torn or dented, no refund or exchange will be allowed.

PRODUCT IMAGES AND DESCRIPTIONS

Baobab Photo makes every effort to display the image and colours of the artworks on the website as accurately as possible. The actual color you see depends on the resolution of your monitor and its colour calibration, brightness and contrast settings. Baobab Photo cannot guarantee that the image you see on your monitor will be exactly the same as the product you receive.

Additionally, there will be slight variations in the product you receive vs the image you see onscreen as there are colour variations between the different products.  For example, the same image printed on Acrylic, Metal Print and Canvas Canvas will have slightly different colour variation.  These slight variations do not qualify as reason for returns or refund.

All efforts will be made to ensure product image, pricing, description, availability and dimensions are provided accurately. Any errors or incomplete information due to typographical errors, inaccuracies, omissions or technological glitches are unintended. Baobab Photo reserves the right to correct or update the information at any time without prior notice (including after submission of order). 

DISCLAIMER AND LIMITED LIABILITY

The contents of the www.karenlucasphoto.com/art website are on an “as is” basis without warranties of any kind, whether expressed or implied.  Baobab Photo does not warrant that your use of its website will be uninterrupted or error- free, or that its website or server is free of viruses or other harmful elements.  Your use of its website is at your sole risk.  Baobab Photo shall not be liable for any direct or indirect loss, damage, or liability of any kind related to your use of its website.  If the user is not satisfied with the website or the terms and conditions, he/she is advised to discontinue using the website.

APPLICABLE LAW

Should any dispute occurs, it shall be resolved exclusively by the authorities in Singapore in accordance to the law of Singapore.
